Project Arkinon is an independent digital art project. Its experiments, artworks and associated digital collectibles are created for artistic, creative and experimental purposes.

Digital collectibles are not investments, financial products, securities or promises of financial return. They should not be acquired with any expectation of profit, appreciation or future resale value.

Participation is entirely voluntary and at your own discretion.

Project Arkinon makes no guarantees regarding the present or future value, market demand, liquidity or resale potential of any digital collectible.

Digital collectibles may have no resale market or monetary value whatsoever. You may lose some or all of the funds spent acquiring them.

Project Arkinon does not provide financial, investment, tax or legal advice. You are solely responsible for any decisions you make regarding the acquisition, ownership or transfer of digital collectibles.

Minting and interacting with blockchain-based experiments involves risks.

You acknowledge and accept that:

• All minting transactions are initiated at your own discretion and risk.
• Blockchain transactions are generally irreversible once confirmed.
• Network congestion, technical failures or wallet issues may cause transactions to fail or behave unexpectedly.
• Gas fees and network transaction costs may be incurred regardless of whether a transaction succeeds.
• Project Arkinon is not responsible for losses arising from failed, delayed, duplicated or incorrectly submitted transactions, except where liability cannot lawfully be excluded.
• You are responsible for checking transaction details, wallet addresses and amounts before confirming any transaction.

Project Arkinon does not guarantee that every minting attempt will be successful.

Digital collectibles may rely on third-party blockchain networks, wallets, marketplaces and other external infrastructure.

Project Arkinon does not control these services and cannot guarantee their availability, security, reliability or continued operation.

You are responsible for maintaining the security of your wallet, private keys and recovery phrases.

Project Arkinon cannot recover lost digital collectibles, reverse blockchain transactions or restore access to wallets.

Each Project Arkinon experiment may operate under its own rules, mechanics, conditions and intended outcomes.

Some experiments may involve randomness, time-based changes, user participation or autonomous smart contract behaviour.

You acknowledge that experimental software and smart contracts may contain bugs, vulnerabilities or unexpected behaviour.

Project Arkinon does not guarantee that an experiment will operate continuously, remain accessible indefinitely or produce any particular outcome.

Experiments may be modified, discontinued or become inaccessible as circumstances require.

Unless otherwise stated, acquiring a digital collectible provides ownership of the associated blockchain token.

Ownership of a token does not automatically transfer copyright, intellectual property rights or ownership of the underlying artwork.

Unless expressly stated otherwise, all intellectual property rights in the artwork, website, branding and associated materials remain with their respective owners.

Acquiring a digital collectible does not grant ownership or control over Project Arkinon, its experiments or its underlying technology.

Project Arkinon does not operate or control independent secondary marketplaces.

Any purchase, sale, exchange or transfer conducted through a third-party marketplace is between the parties involved.

Project Arkinon is not responsible for marketplace fees, pricing, fraudulent listings, scams, disputes or losses arising from secondary market activity.

There is no guarantee that any digital collectible can be sold, transferred or exchanged.

The website and its experiments may interact with third-party services, including blockchain networks, wallet providers, marketplaces, hosting providers and external websites.

These services operate independently of Project Arkinon and may be subject to their own terms, conditions and privacy policies.

Project Arkinon is not responsible for the actions, availability or performance of third-party services.

To the maximum extent permitted by applicable law, Project Arkinon and its creators shall not be liable for any indirect, incidental, consequential or economic loss arising from or relating to:

• Participation in any Project Arkinon experiment.
• Minting, acquiring, holding, selling or transferring digital collectibles.
• Changes in the market value or availability of digital collectibles.
• Blockchain network failures, wallet issues or transaction errors.
• Smart contract vulnerabilities, exploits or unexpected behaviour.
• Loss of access to digital assets or wallets.
• Website interruptions, technical failures or loss of data.

You acknowledge that participation in blockchain-based experiments carries inherent risks and that you accept responsibility for your participation.

Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under applicable consumer protection laws.

Project Arkinon reserves the right to update, modify, suspend or discontinue any part of its website or experiments.

The experimental nature of the project means that features, functionality, artwork and associated experiences may change over time.

No guarantee is made that any particular experiment, feature or website functionality will remain available indefinitely.

By using this website or participating in a Project Arkinon experiment, you acknowledge that you have read, understood and agreed to these Terms and Conditions.

If you do not agree with these Terms, you should not participate in any Project Arkinon experiment or mint any associated digital collectible.

These Terms and Conditions are governed by the laws applicable in Australia.

Any disputes will be subject to the jurisdiction of the applicable Australian courts, subject to any mandatory rights or protections available under applicable law.
